    Trust Classifications

    Israeli tax law classifies trusts into four main categories based on the residency of the settlor, trustee, and beneficiaries: (1) Israeli resident trust (settlor is Israeli) – income attributed to settlor; (2) Non-resident trust (foreign settlor, foreign beneficiaries) – generally exempt on foreign income; (3) Trust for the benefit of Israeli residents (foreign settlor, Israeli beneficiaries) – complex attribution rules; (4) Public trust – tax-exempt if serving public purposes.

    Reporting Obligations

    • Every Israeli person involved in a trust must report its existence to the ITA
    • Annual returns must be filed for Israeli resident trusts
    • Distribution reports required when trust income is paid to beneficiaries
    • Non-compliance can result in severe penalties
